Pitch Booking Terms & Conditions

DEFINITIONS:

The following definitions and rules of interpretation shall apply to these terms and conditions:

• AGP: the artificial grass pitch at Lindum Hockey Club, St Giles Avenue, Lincoln, LN2 4PE including dug-outs, goals and the spectator's area enclosed within the perimeter fence surrounding the pitch.
• Booking Period: the period during which the Hirer seeks to be permitted use of the AGP subject to these terms and conditions.
• Hirer: the Party seeking to be permitted use of the AGP under these terms and conditions.
• LHC: Lindum Hockey Club

1. TERMS OF HIRE

1. Booking of the AGP is to be confirmed upon receipt of payment by LHC. Regular users of the AGP will be invoiced.
2. LHC reserves the right to refuse or cancel the hiring of the AGP. LHC shall not be liable for any payment whatsoever, either to the Hirer or to any third party, in respect of a claim for compensation or damage arising in any matter resulting from the cancellation of the same
3. LHC does not accept responsibility for any loss or damage suffered by the Hirer or any third party as a result of any occurrence or accident, necessitating the cancellation or interruption of the hiring.
4. The Hirer shall not assign or sublet the permission to use the AGP without the prior written consent of the LHC.
5. LHC reserves the right to alter charges without notice. The Hirer will be informed of the change in charges and given the right to cancel without prejudice.
6. The Hirer is responsible for ensuring that appropriate first aid procedures are followed during the Booking Period. The Hiring of the AGP does not include the provision of first aid equipment.
7. In the event of inclement weather, it remains the responsibility of the Hirer to ascertain the condition of the AGP. In the event of the AGP being unplayable, any charge in respect of the Booking Period shall be refunded within 21 days of the Booking Period. The final decision as to the playability of the surfaces shall lie solely with LHC.
8. The AGP is to be used exclusively for hockey. Failure to comply with this condition will result in the immediate cancellation of the booking and no refund will be made in these circumstances.
9. The only footwear permitted on the AGP is clean trainers and shoes designed for hockey. In particular, football boots or studded shoes are not permitted to be used on the AGP. The Hirer shall be liable for any damage caused by the use of inappropriate or dirty footwear.
10. The Hirer shall be responsible for any damage cause to the AGP and shall pay damages in line with the reasonable cost of repairing the damage and the administrative expenses to LHC. LHC shall invoice the Hirer for any damages and administrative expenses within 60 days of the Booking Period and the Hirer shall pay any such invoice within 21 days of receipt.

2. CANCELLATION

1. Where the Hirer wishes to cancel a booking, the Hirer must notify LHC, in writing (Cancellation Notice). The Cancellation Notice is to be sent by email to [Email address].
2. Where a Cancellation Notice is given more than 4 weeks prior to the commencement of the Booking Period, a 100% refund will be made to the Hirer and shall be paid by LHC to the Hirer within 4 weeks from the date of the Cancellation Notice.
3. Where a Cancellation Notice is given less than 4 weeks prior to the commencement of the Booking Period, no refund shall apply.

3. EXCLUSIONS

1. For the avoidance of doubt, these terms and conditions relate exclusively to the hire of the AGP and do not, in any way, permit the use of changing facilities or clubhouse facilities. The use of such other facilities is to be dealt with under a separate agreement with Lindum Sports Association.
2. LHC cannot be held liable for the death or injury to any person arising out of the use of the AGP other than as a result of the negligence of LHC. The Hirer is advised to protect their obligations under this condition by effecting appropriate public liability insurance.
